Irked by people’s sufferings due to PDD employees’ strike, CCI urges Govt to resolve issue without delay
Chamber of Commerce and Industries Jammu (CCI) convened an urgent meeting of the members to discuss the current situation arising due to indefinite strike of power employees as a result of which the common man has suffered a lot.
The meeting held here today at the Chamber House was chaired by President CCI Jammu, Arun Gupta and attended among others by Sr. Vice President, Anil Gupta; Jr. Vice President, Rajeev Gupta; Secretary General, Gaurav Gupta; Secretary, Rajesh Gupta and Treasurer, Rajesh Gupta.
Addressing media persons after the meeting, President CCI Jammu, Arun Gupta said that it is a matter of great concern that common man is being made to suffer on account of the tussle between the PDD employees and the UT administration in resolving the issues of these employees.
Arun Gupta said that the people are already suffering due to the ongoing Covid pandemic, and now without electricity they have been left to fend for themselves. He said the traders and business establishments including industries have been adversely affected as they cannot run their businesses in absence of electricity especially in view of the fact that nowadays substantial transactions related to business, commerce and industries are conducted online. Even the students attending online classes are suffering badly as the online facility depends on power supply. It would be wrong to state that every section of the society is suffering due to indefinite strike of the employees of the Power Department, Arun Gupta asserted.
On behalf of the Chamber of Commerce and Industries Jammu, Arun Gupta made a fervent appeal to the Union Territory Administration to resolve the genuine issues of the PDD employees at the earliest so that the normal power supply is restored and the people do not have to suffer any more.
Meanwhile, Arun Gupta informed that this auditorium for which the foundation was laid today will be used for organizing multiple programmes including seminars, conferences and other business related objectives. CCI delegation meets LG Sinha, seeks change in Smart City dominion, limit for constructions near defence installations
A delegation of Chamber of Commerce and Industry Jammu today met LG Manoj Sinha and sought change in jurisdiction of Smart City from walled city to new Jammu city on the lines of Raipur in Chhattisgarh and change the limit for constructions near defence installations by making the same at par with other states across the nation.
The CCI delegation led by its President Arun Gupta called on LG Sinha and also submitted a memorandum raising the burning issues of the people of the region. The issues raised during the meeting include change in limit for constructions near army areas as in J&K the limit is 100 meters but in other states the same is only 10 meters, which is in accordance with defence ministry’s guidelines. The CCI team demanded the same limit as allowed in other states to maintain a clear line of sight for effective surveillance. The CCI said that at least in the municipal limits these restrictions shall be applicable upto 10 meters only and in other areas these restrictions should be upto 50 meters. Expressing gratitude for making Jammu Smart City, the delegation said that the walled city is quite congested therefore making it smart by uprooting traders on one pretext or the other is in no way justified therefore it is advisable to create a new Jammu city under the smart city on the pattern of Raipur Project that provided for creation of new city without disturbing the existing city in Chhattisgarh. The CCI delegation also appealed to LG Sinha for asking JDA and Housing Board to develop new residential areas and commercial sites as the same have not been established for over last three decades. It was also demanded that expired Lease Deeds of some allottees in Sabzi Mandi and Fruit Mandi Narwal should be renewed after charging the minimum possible premium. Similarly, issue of some commercial shops in Bahu Plaza area which were allotted to some persons but the possession was not given to allottees and no lease deeds have been executed was also raised and it was sought that the same be sorted out amicably. The CCI also sought revival of The Citizens Cooperative Bank Ltd. Jammu. The apex body of traders has asked for establishing new Public Sector Undertakings in Railways and Defence sectors on the pattern of other states to generate employment avenues in J&K. The President Arun Gupta also sought change in land titles in J&K as large chunks of land in Jammu have been declared as “Gair Mumkin Khud” by Revenue Department despite the fact that no water body is passing through these lands. It was said that registration and construction activities on these lands are barred therefore there is the need to redefine the “Kism” of this type of land and also a Policy should be formulated to allow the commercial and construction activities on these land chunks. Besides CCI demanded ownership rights for Industry/ Warehouse, incentives to existing industries also on the line of new policy, incentives to small entrepreneurs under new industrial policy by necessary amendments, and VAT and Power Amnesty Schemes. The CCI also took up the matter of cancellation of lease deeds and eviction of allottees in Industrial areas. The delegation said there are some plot holders in industrial areas who have obtained provisional registration but due to some reasons no effective steps were taken by them to start their units. It was demanded that their provisional registration be revalidated and should be provided one last opportunity to start their units under time bound manner within one year. The CCI also reiterated the demand of restoring the livelihood of Single JKEL-2 Liquor License Holders, who have lost their source of income. The LG Sinha assured that all the demands will be looked after and addressed on priority.

Be considerate with traders during festive season: CCI urges JMC Comm
Chamber of Commerce and Industry (CCI) Jammu President Arun Gupta on Tuesday urged JMC Commissioner Avny Lavasa to deal with the trader fraternity of the region considerately and facilitate them to make up the losses they have incurred in the last couple of years due to COVID-19 pandemic and law and order problems in the UT.
A delegation of CCI led by its President met Commissioner JMC Avny Lavasa and discussed various issues concerning traders of Jammu city.
Arun Gupta said that JMC should show considerate view towards the traders’ fraternity and should not impose unnecessary restrictions in the name of inspections as the business community is already facing lots of hardships. He said that if the traders are using some extra space for showcasing their products the JMC should not act in an arbitrary manner to penalize them as leniency in this case would help them to have good business.

He appealed to the JMC Commissioner to implement 100 per cent construction of horticulture mandis , Warehousing as per the Master Plan 2032.
The CCI delegation also urged the JMC Commissioner to rescind the notice given to shopkeepers at Gole Market for vacating land chunks wherein they are running their business for the last over 50 years. Arun Gupta further asserted that what is the fun of demanding NOC from Housing Board/JDA of the Plot Holders who wanted to raise constructions on their plots when already the aforesaid department has accorded them the freeholder rights which are legally sound enough and is in a way a nod from the department to carry out constructions independently.
The delegation however appreciated the novel ideas implemented by the JMC to woo visitors to Jammu especially light and sound show, selfie point, vertical gardens, etc.
After giving a patient hearing to the delegation, the JMC Commissioner assured to look into all the matters on priority and said that no trader will be harassed unnecessarily as the Corporation works professionally. Besides, the CCI delegation also raised the issue of residents of Gandhi Nagar, who have been told to vacate 10 feet land of their plots by an arbitrary order seeking its immediate rescinding.

CCI delegation calls on Sh. Ram Chandra Prasad Singh Hon’ble Union Minister of Steel Government of India
A delegation of Chamber of Commerce & Industry Jammu led by Sh. Arun Gupta, President and accompanied by Sh. Anil Gupta, Sr. Vice President, Sh. Rajeev Gupta, Jr. Vice President, Sh. Gaurav Gupta, Secretary General and Sh. Rajesh Gupta called on Sh. Ram Chandra Prasad Singh Hon’ble Union Minister of Steel Government of India at Jammu and discussed with him various issues and also submitted a representation which reads as under:
To meet the demand of ongoing local projects such as road widening, flyovers and bridges etc., at present the local contractors and the dealers have to import the required steel from outside the State. In this context we request your goodself that Steel Ministry of India should install a big PSU Unit particularly in Jammu to meet the demand of local contractors and local dealers for supply of steel besides employment at large.
Sir, the yard of Steel Authority of India situated in Jammu which is feeding entire J&K is not fully operational due to availability of limited Stocks, thus defeating the purpose for which it was established. We request that all the stocks should be available in the yard of Steel Authority of India so that the registered units can take benefit of the same.
Before GST local scrap was sourced through SICOP which had notional entry for VAT. However after GST iron scrap is attracting 18% GST. This has resulted in large number of fake invoices being traded putting the secondary steel manufacturers in a legal tangle along with high cost of inventory. To curb this menace, scrap should attract 5% GST.
The Union Minister assured to consider the demands and suggestions put forth by CCI and thereafter take the requisite measures in this direction.

Arun Gupta said that there is a dire need for establishing new Public Sector Undertakings in Jammu Province and in this regard the industries of Railway and Defence sectors are the best options. Just like other states of the nation the units of the aforesaid industries should be established by the Central Government here as it will undoubtedly generate huge employment opportunities for the youth of the State besides giving a fillip to the UT’s economy.
The Jammu Chamber also sought refund of SGST to industrial units of UT of J&K despite the assurance give by the then Finance Minister of J&K that the SGST refund will be made within one month to the Industrial Units but till date nothing has been done in this regard.
Besides, Chamber President also demanded the benefits of New Industrial Policy including the benefit of GST should also be given to existing Industrial Units of Jammu region. 25 per cent share of New Industrial Policy should be reserved for the stake holders of Jammu Province as there are lakhs of unemployed youth in Jammu, he added.
Jammu Chamber has also expressed resentment over the proposal of big companies like Reliance to open stores in Jammu in the retail sector, saying that if this happens then small shopkeepers of Jammu will be ruined and their shops will be closed.
Meanwhile while welcoming the decision of the Govt to start beating retreat at Suchetgarh border; the delegation members said that this would definitely increase the tourist footfall in the region. The Chamber President said that there is a huge tourist potential in Jammu Province which needs to be exploited to boost the economy of the region. He said Peer Panchal mountainous region, besides the areas of Bhaderwah, Bani, Kishtwar and Doda despite having vast tourism potential need to be brought on the Tourism map to exploit the potential fully and boost the economy.
The Chamber has also discusses these issues comprising clarity on land policy, Labour Policy, Redefining of Land Types, Durbar Move , rehabilitation policy, completion of Pending ongoing Projects, delay in payment to contractors, issue of wine traders, sand mining, Crushers and brick kiln trade etc with the Union Minister.
The Union Minister assured to consider the demands and suggestions put forth by CCI and thereafter take the requisite measures in this direction.
Other Office Bearers who accompanied the delegation include Sh. Anil Gupta, Sr. Vice President, Sh. Rajeev Gupta, Jr. Vice President, Sh. Gaurav Gupta, Secretary General, Sh. Rajesh Gupta, Secretary and Sh. Rajesh Gupta, Treasurer

Successful Bandh vindicated Chamber’s stance, will continue to fight for cause of Jammu Province
The Chamber of Commerce and Industry (CCI) Jammu on Wednesday expressed gratitude towards people of Jammu province especially the trader fraternity and Jammu High Court Bar Association and other Bars of Jammu province, Transporters and FOI for extending wholehearted support in making the Wednesday Bandh a great success.
In a statement issued to media persons, CCI President Arun Gupta said that the overwhelming support which the Chamber has received from various quarters of the society in the entire Jammu province is the testimony to the fact that stand taken by apex body of traders is hundred percent right and the government should consider the demands henceforth. He categorically said that the motive of the CCI was in no way to oppose the government as far as abrogation of Article 370 is concerned as some sections in the political circles are trying to promulgate but the only reason behind this resentment is the lopsided policies of the J&K Govt. towards the business community of the region.
The purpose behind the Bandh by the CCI was to raise the voice of traders of Jammu province as lately the decisions taken by the government especially end to Darbar Move practice, treatment with wine shop owners, abrupt closure of bars, SOP for Banquets, debarring of Mahajans, Khatris, Sikhs and Jains communities from purchasing of agricultural land in J&K, issue of Sand mining, Crushers and brick kiln trade, passenger tax on commercial vehicles, and with current issues of Jammu Bar Association and now the move to invite Reliance stores’ chain in the UT will prove out to be detrimental for the trading community”, he said adding that the response which the CCI has received from all the districts of Jammu including Samba, Poonch, Reasi, Rajouri, Udhampur, Kishtwar and Doda besides Jammu has made it evident that what CCI is professing the demand of people of Jammu and the government should act fast in the matter and pay heed to demands as soon as possible. The Autocratic attitude of the higher administration not considering to our repeatedly request resulted into the todays silent protest from the business community.
The Jammu Chamber President said that unprecedented support to the Bandh call has emboldened the Chamber to continue with its efforts to ensure justice for the people of Jammu. He expressed gratitude towards all the organizations, political outfits, friendly behavior of the police personnel, the business organization of entire province in particular comprising of wholesalers, retailers, small traders and media fraternity which extended support to the Bandh call. He assured that CCI will continue to work for ensuring justice to the people especially traders and like the days before abrogation of Article 370, the CCI will continue its endeavours to fight for the genuine cause of the people.

CCI calls for Jammu Bandh on Sept 22
Traders’ body alleges discrimination as never before
JAMMU: The Chamber of Commerce and Industry (CCI) Jammu expressed great anguish over the discrimination of highest degree with traders of Jammu region by the government. Looking into the atrocities of the government on the business class of Jammu Division, Jammu Chamber has decided to give a clarion call for Jammu Bandh on September 22, 2021 due to directions-less policies of the government which are hitting the business fraternity especially in Jammu region.
There are certain points which Chamber has raised from time to time with the officers sitting at the helm of affairs which read as under:
Closure of Wine/Bars Vendors
Firstly it was wine shop owners who got the jolt by the so-called New Excise Policy and now the Liquor Bar owners are the next targets of the anti-Jammu administration. Hundreds of wine traders have lost their livelihood after the introduction of e-auction of liquor vends in Jammu and Kashmir. Majority of 228 liquor traders lost their shops in the e-auction conducted recently in the Jammu and Kashmir.
Almost after a gap of two months when the government has e-auctioned wine shops, the liquor bars across the Union Territory of Jammu and Kashmir have been briefly closed as the Excise Department has sought renewal of licenses and ‘No Objection Certificate’ from the more than 20 department to be obtained by the owners/operators.
Nearly 250 liquor bars are running in the UT of J&K including in private hotels, clubs owned are functional across the Union territory and thousands of people are engaged in this business for the last several years. The above move of the government as badly affected their livelihood in large. We have requested the government several times in this regard but government is not paying any attention
Issue of banquet Halls
Banquet Halls are also facing the brunt of government baseless restriction on number of guests. As we know, Covid-19 has broken down the backbone of our traders. Banquet halls are the worst sufferers due to continued lock downs on account of Pandemic Covid-19 and now government has allowed only 25 persons to attend the social/religious gatherings. The majority of banquet halls are spread over more than 10-40 Kanals of land and what to speak of 25 people, the crowd of 200 persons will be barely visible unless restrictions are completely lifted the people would avoid booking of such huge complexes for just 25 persons only for social cultural and other functions which will further aggravate the hardships for this section of business community. We therefore request to fix the capping criteria in case of banquet halls as per their size and capacity and allow these to function with 50% capacity.
Opening of Reliance Stores
Jammu Chamber has also expressed resentment over the proposal of big companies like Reliance to open stores in Jammu in the retail sector, saying that if this happens then small shopkeepers of Jammu will be ruined and their shops will be closed. Inspite of adding opportunities for business, the directionless government has snatched away what was in the hand of traders which is unacceptable.
Ending of decade-long Annual Darbar Move
The Annual Darbar Move process was aimed at maintaining communal harmony and brotherhood especially among the people of Jammu and Kashmir regions and ending this process would have an adverse impact not only upon the traditional bond between the two regions and their people but also on the business community. Thousands of families from Kashmir and Jammu used to move along with darbar to spend winter and summers in Jammu and Kashmir. It has severely affected on the traders of Jammu as well as Kashmir regions.
Debarring of Mahajan, Khatri , Sikhs and Jains communities from purchasing agricultural lands in J&K
Under alleged conspiracy, the members of these communities are debarred from buying or selling land in the J&K Union Territory. It seems to be a caste based system in purchasing and selling land in Jammu and Kashmir under new Land Laws amended by the Centre after abrogation of Article 370. The members of these communities can purchase and sell land across the country but it is extremely depressing that they cannot purchase even one Kanal of agricultural land whereas there is no such restriction on people belonging to other communities. All the citizens of the country are treated equally before law irrespective of caste, colour or creed but the government adopts dual policy and gross injustice with these communities. Government should revoke its order debarring the aforesaid communities from buying or selling land in J&K.
Sand mining, Crushers and Brick kiln Trade
The policy adopted by the Geology and Mining Department with regard to allotment of mining and extraction contracts as alarming and against public interest. The lack of protective mechanisms in the policy has deprived thousands of families of their livelihood and exposed consumers to exploitation by a mining syndicate. Over 60% of mining contracts have gone to the outsiders. From contractors to sand diggers, labourers to transporters, who are directly or indirectly associated with the extraction of minerals, all have lost their livelihood. Some of them, especially sand diggers have been involved in these activities for decades. The above move of J&K Government has affected the livelihood of thousands of people in the region.
Visit of MPs to J&K
The outreach programme started by the Government of India in which over 300 Members of Parliament visiting Jammu and Kashmir seems to be solely meant for Kashmir as practically Jammu is not on their itinerary and it looks that the region is declared as out of bound for the visiting delegates. Those who visited Jammu they only preferred to meet the leaders belonging to a particular party, ignoring the stakeholders of Jammu region. It seems that government is acting totally against the interest of the Jammu people and is appeasing the people of the other region despite Jammu being the nationalist and staunch supporter of the government.
Looking into such prejudice with the people of Jammu in general and traders in particular the CCI has decided to go on an agitation path and the first step in this regard is the Jammu Bandh on September 22. He appealed to the people of the region to extend support to this call for awakening the government from deep slumber as it has been taking people of Jammu as for granted and paying full attention towards Kashmir which is unwarranted and will not be tolerated at any cost.
Passenger Tax on Commercial Vehicles
The Passenger tax on Commercial Vehicles is not applicable anywhere in any UT of India. We question the government why it is being charged in our UT.

CCI resents NHAI’s anti-encroachment drive, seeks approach path for business establishments
The Chamber of Commerce and Industries (CCI), Jammu on Tuesday resented the ongoing anti-encroachment drive led by National Highways Authority of India (NHAI) officials along NH-44 by terming it as arbitrary and sought provision to allow path for having access to business establishments on highway as already businessmen are passing through tough time due to pandemic COVID-19.
In this context, a delegation of CCI Jammu headed by its President Arun Gupta met Regional Officer, NHAI, J&K, Rohin Gupta and expressed surprise and pain that how come they have started dismantling fronts of shops and other business establishments without serving prior notices. Arun Gupta demanded a fair deal in the matter claiming that the access to shops and other establishments have also been damaged by the NHAI, which is sheer injustice as nowhere it is seen that the path for approaching a business establishment is blocked or damaged by the authorities concerned.
He also said that the business community is facing an ordeal due to COVID-19 pandemic as many of the traders are on the verge of starvation as their businesses have been severely affected and this ruthless drive will force them to even manage a day’s meal for them and their families. He said that this uncalled for and should be stopped immediately or at least the affected traders be given access to their establishments so that their clients or customers can visit them and they could earn bread and butter with dignity.
The CCI President demanded that NHAI should immediately repair the front portions of the shops and other establishments to restore business activity as development after closing the shutters of trader brethren is no development at all. He also appealed to NHAI to simplify the rules of giving access to traders to reach their establishments claiming that rules should be for the convenience of the people and not for harassing them. After listening patiently to the issues raised by the CCI delegation, Rohin assured that he would immediately pass on the instruction to the concerned officers to mark the new marking on the national highway and the new notices to be served to all the concerned establishments who have encroached on the area of the National highway authorities.
Those who accompanied the delegation include Sh. Anil Gupta, Sr. Vice President, Sh. Rajeev Gupta, Jr. Vice President, Sh. Gaurav Gupta, Secretary General, Sh. Rajesh Gupta, Secretary and Sh. Rajesh Gupta, Treasurer.

A delegation of Chamber of Commerce & Industry Jammu led by Sh. Arun Gupta, President and accompanied by Sh. Anil Gupta, Sr. Vice President, Sh. Rajeev Gupta, Jr. Vice President, Sh. Rajesh Gupta, Secretary and Sh. Rajesh Gupta, Treasurer today called on Sh. Arun Kumar Mehta, Chief Secretary UT of J&K in his Office Chambers at Civil Secretariat Jammu and discussed with him various issues and also submitted a representation which reads as under:
Raghunath Mandir
The Jammu City is known as City of Temples. Earlier it was visited by thousands of devotees from Jammu City and also lakhs of pilgrims who visited Jammu city. Now due to the picket installed outside and inside of the temple, only few people are left who are visiting this temple. We request to kindly lift these pickets from the temple to make it possible for every devotee / pilgrim to visit this temple freely.
Amendment of Land Law
The land law has been framed as early during Maharajas rule according to which Mahajans and Khatries were allowed to purchase/keep 10 marlas of agriculture land only. Since then many amendments including “ZARIISLAHAT” have taken place but the said clause have not been amended. We request that the limit of 10 marlas should be abolished.
Redefining of Land Types
Large chunk of land in Jammu have been declared as “Gair Mumkin Khud” by Revenue Department despite the fact that no water body is passing through these lands.Registration and Construction activities on these lands is barred. There is the need to redefine the “Kism” of this type of land and also a Policy should be formulated to allow the commercial and construction activities on those lands.
Registration of outside Vehicles
The RTO Jammu/Srinagar have issued notification regarding registration of vehicles being purchased / registered from outside and brought into the UT of J&K, requires fresh registration and road tax in J&K which is not in vogue anywhere in India thus defeating the theory of “One Nation One Tax”. This needs to be undone forthwith.
Development of Jammu as Smart City
Jammu is known as City of Temples and we are thankful to the Hon’ble Prime Minister Sh. Narendra Modi for announcing to develop Jammu as a Smart City. The work on this project is going on and much more needs to be done for which the cooperation of various departments is very essential. For instance the electric wires / conductors are hanging on the PDD Poles having no symmetry at all giving a ugly look. Besides this sewerage and drainage system is totally defunct. The sewerage pipes remain blocked and the drains are chocked due to which the dirty water remains overflowing on the lanes and by-lanes giving an ugly look to this god gifted beautiful city of temples. We request your personal intervention to complete this smart city project.
Policy for Rehabilitation
The Jammu is going to be developed as a Smart City which is a welcome step. In this connection we wish to request that the people who will be effected by implementing the Smart City Project should be rehabilitated first.
Creation of Commercial and Residential Sites
Since last three decades the JDA as well as the Housing Board have not established any commercial area or residential colony due to which there is dearth of both commercial sites as well as residential area. The possibilities of same may be explored.
Special Relief Package for Small Scale Business and unemployed youth
We appreciate the Government move to provided free rations to poor people during the pandemic and lockdowns. We request that a Revival Package be announced in order to give relief to the small scale business houses especially the non essential shopkeepers who are the worst sufferers during the lock down period.
Recently a Package of Rs. 28400 Crore was announced by the Government for J&K Industry, we request that 30% of this earmarked amount should be reserved for the stake holders of Jammu Province as there are lakhs of unemployed youth in Jammu.
Special Incentives for Tourism, Transport and Trade Sector
Sir, the Tourism/Transport/Trade sectors have been badly hit due to continuous lockdown. We urge the government to make some mechanism for survival and revival of these sectors.
NOC from the Fire Department
The Fire Department is issuing the “NOC” valid for one year only for Industrial Purpose/Hotel Industry also. It takes almost more than six months for applying for renewal and issuing of the NOC. We, therefore request your goodself that the NOC from the Fire Department should be made valid for atleast 3 years.
Development of Tourism
Peer Panchal mountainous region of the Jammu be explored and developed as a Tourist hub which otherwise is neglected till now. Despite tall claims the areas of Bhaderwah, Bani, Sarthal, Kishtwar and Doda despite having vast tourism potential are being ignored. The Road connectivity from Jammu to Bani be made functional so that the people of Jammu and Gurdaspur district shall flow into this place instead of going to Dalhousie and other places of Himachal. Even the Road connecting Patnitop with Jammu is in depilated condition and steps be taken to repair that stretch. Till now no commercial activity is allowed in Patnitop. We request to allow commercial activities on pattern of Pahalgam and Gulmarg.
We also request that Defence Ministry be requested to arrange Retreat Ceremony like Wagha Border in Amritsar at Suchtgarh R.S.Pura Jammu to increase the tourist flow in that area.
Completion & Pending ongoing Projects
We wish to request that the pending work on the ongoing project like Artificial Lake on River Tawi, Mubarak Mandi Heritage Complex, Development of Banks of River Tawi on the pattern of Sabarmati, Heritage Circuit be completed at the earliest.
VAT Amnesty Scheme
The government has earlier announced VAT Amnesty scheme giving an opportunity to the defaulter of VAT to deposit their VAT dues without interest and penalties. But due to continued lockdown and financial crunch some traders could not avail the benefit of the scheme as such we request that these traders be provided one more opportunity to deposit their VAT dues without interest and penalties.
Power Amnesty Scheme
The Power Amnesty scheme was announced when the Covid-19 was at its peak and total business was under lockdown. No doubt this scheme was further extended for some period but during that period also all the business establishment were closed / semi closed and the business community was having no money to deposit / avail this scheme.
The Chamber of Commerce & Industry has been fervently pleading to give one last opportunity to the defaulting consumers to deposit / clear their power due without interest and penalties. The Chamber is firmly of the view that this last opportunity will not only save the Traders / Industrialists from undue litigation but will also generate revenue for the government.
Rentals
We request that all the rentals of business community payable to JDA, JMC, SIDCO, SICOP and J&K Housing board should be borne by the government for the lockdown period.
Execution of Lease Deeds
The period of lease deeds in respect of some allottees has expired. We request that their lease periods should be extended further after charging minimum possible premium. Further some commercial sites have been allotted to some persons and regular rent is being charged and received from them but no lease deeds have been executed with them. We request that lease deeds be executed by the concerned agencies with the said allotees without any delay.
Vaccination Drive
We request to intensify the Vaccination drive across the Union Territory of Jammu and Kashmir especially for Traders as their establishments are visited by huge number of consumers daily thus increasing the chance of risk to those who are managing these establishments by physically being present there.
Annual Darbar Move
The Annual Darbar Move process was aimed at maintaining communal harmony among the people of Jammu and Kashmir regions. We therefore request to continue the Annual Darbar Move practice.
Issue of banquet Halls
Your goodself is well aware that Covid-19 has broken down the backbone of our traders. Banquet halls are the worst sufferers due to continued lock downs on account of Pandemic Covid-19 and now government has allowed only 25 persons to attend the social/religious gatherings. Sir, the majority of banquet halls are spread over more than 10-40 Kanals of land and what to speak of 25 people, the crowd of 200 persons will be barely visible unless restrictions are completely lifted the people would avoid booking of such huge complexes for just 25 persons only for social cultural and other functions which will further aggravate the hardships for this section of business community. We therefore request to fix the capping criteria in case of banquet halls as per their size and capacity and allow these to function with 50% capacity.
Cinema Halls
We request that the Cinema Hall be allowed to operate with 50% capacity and only those persons should be allowed to visit cinema halls who are vaccinated.
We hope being native and well versed with the problems of Jammu Region your goodself shall consider our suggestions with a practical approach and take a prompt and favourable action in this regard.
Sh. Arun Kumar Mehta, Chief Secretary gave a patient hearing to the grievances, views and suggestions put forth by the Chamber delegation and also assured that all the issues raised todays meeting will receive preferred attention and shall be addressed on priority.

CCI calls on Advisor Bhatnagar, discusses issues of business community
A delegation of Chamber of Commerce and Industry Jammu led by its President, Arun Gupta met the Advisor to Lt Governor, Rajiv Rai Bhatnagar and discussed various issues related to the business community.
During the detailed deliberations and discussions, Sh. Arun Gupta, President CCI urged the Advisor to intensify the vaccination drive across the Jammu and Kashmir Union Territory especially for the traders as their establishments are visited by huge number of consumers on a daily basis thus increasing the chances of risk of Covid-19 virus to those managing these establishments by being physically present there.
The other issue that came to be discussed with Advisor Bhatnagar was the dilapidated condition of roads in Jammu especially those leading to business hubs including industrial estates, Ware House, Transport Nagar, etc. The Chamber President asked him to fix accountability of engineers of R&B Department monitoring the construction of roads across Jammu region.
Since Rajiv Rai Bhatnagar is also holding the charge of Revenue Department, Ash. Arun Gupta, President CCI urged him to do justice with members of Mahajan and Khatri communities who have been debarred from purchasing agricultural lands in the Union Territory of Jammu and Kashmir.
Other issues raised by the Chamber delegation were the establishment of single window system for re-opening of schools in J&K and continuation of Annual Darbar Move practice.
The Chamber President conveyed to the Advisor that the Annual Darbar Move process was aimed at maintaining communal harmony and brotherhood especially among the people of Jammu and Kashmir regions and ending this process would have an adverse impact not only upon the traditional bond between the two regions and their people but also on the business community. Besides, there is need to look the matter of people having their registered and legal properties on Khads as due to chaos created by the Revenue officials they are not able to sell and buy their properties.
Advisor Rajiv Rai Bhatnagar gave a patient hearing to the Chamber delegation members and assured them of early consideration of the issues raised by the Chamber. He also appreciated the Jammu Chamber of Commerce and Industry for discharging its Corporate Social Responsibility by carrying out several works during the first and second wave of Covid-19 across Jammu.

Associations while taking up the matter with Divisional Commissioner, Dy. Commissioner Jammu and telephonically with the Principal Secretary to Lt Governor, Nitishwar Singh,
prior to the announcement of the aforesaid SOPs.
The CCI believes that the schedule formulated by the administration in this regard in causing too much inconvenience to both the trading community as well as the
people at large and needs to be immediately replaced by a balanced one prepared only after considering all the aspects of the current crisis situation.
CCI President informed that the business community expressed grave concern over the ‘inconvenient’ schedule announced by the Government for their working.
He said that all the associations and federations in unison demanded the change in the SOPs regarding the timings of the business establishments.

JAMMU:Chamber of Commerce and Industry (CCI) Jammu has expressed strong resentment against the attitude of Jammu Municipal Corporation (JMC) for unnecessary harassing the
shopkeepers in city on one pretext or other especially when the region is confronting with second wave of lethal corona virus and business is already on the lowest ebb.
To strongly project the issue before the concerned authority, CCI delegation led by its President Arun Gupta visited JMC Office here at Town Hall and met Commissioner of
the civic body Avny Lavasa in the presence of Mayor Jammu Chander Mohan Gupta.
At the outset, the CCI President expressed displeasure over unwarranted attitude of JMC while dealing with the trader fraternity in Jammu. Citing the ugly episode of
New Plot market a couple of days before where the sleuths of JMC misbehaved with the shopkeepers and some of their customers, Arun said that such kind of unruly behaviour by
government employees is uncalled for and should be restrained by all means. He said that despite government being well aware of the fact that business community in Jammu
faced colossal losses on account of lockdowns and restrictions that followed in the year 2020, it is indulging in ‘monopolizing tactics’ instead of offering solace by
giving some sops or exemptions. The CCI President particularly mentioned the instances of JMC teams wreaking havoc in markets by lifting products of shopkeepers placed
for display thus incurring huge losses besides traumatizing the business community. He also took up the matter of using JCB machines by the civic body to remove pavements
and drain covers constructed by the traders to beautify the surroundings. After giving a patient hearing, JMC Commissioner Avny Lavasa came up with a novel solution of
drawing a yellow line in all the markets to segregate the space between shops and the roads and lanes. It was decided amicably that shopkeepers will not cross this line
while displaying their products and if there is any contravention reported in one month’s time strict action will be taken against the defaulters. It was also decided
that the JMC will first take into confidence the particular market association before going in for any penal action or starting anti encroachment drive. The JMC Commissioner
however, appealed to the people of Jammu especially the trader fraternity to restrain from encroachment as this amounts to difficulty to fellow citizens besides inviting penalty
or other legal action under law.

Jammu Chamber of Commerce & Industry (JCCI) today has expressed great resentment against the new Excise Policy announced by the Jammu and Kashmir UT administration the other day.
Responding to the new policy the JCCI president Arun Gupta during a press conference conducted at the Chamber House here today asserted that the new policy prima facie appears to be aimed at eliminating the local businesspersons from the trade and benefiting only the rich capitalists, that too from outside the Union Territory of J&K. He said that it is quite unfortunate that before finalizing the Excise Policy 2021-22, the apprehensions of the Wine Traders have not been cleared despite repeated protests by them in the City of Temples.
Gupta regretted that despite taking up the matter with the Hon’ble Lt Governor regarding New Excise Policy which directly affecting the livelihood of existing wine traders of J&K, unfortunately nothing has been done in this regard.
“Jammu Chamber has also took up the issue of New Excise Policy with the MOS PMO Dr Jitendra Singh at New Delhi but all in vain,” he said.
While elaborating further the Chamber President said that through e-auction individual will be granted license at only one location thus paving the way for the persons having muscle and money power to bid in name of proxies. This vindicates the apprehension of the wine traders that e-auction will bring big players while eliminating the small ones.
Gupta said the basic structure of grant and renewal of JKEL-2 license having been changed in new policy for JKEL-2 trade through e-auction mode is not only in violation of Excise Act and Rules but also in total disregard to the judgment of J&K High Court.
Gupta also raised serious concern over the hardships which the business community is confronting especially with regard to ban on extraction of minor minerals from river beds and subsequently the sale of the same. He said that such kind of blanket ban on the construction material is not in the interest of any one in the UT. He said that banning mining on the pretext of unauthorized extraction is not at all justified as the administration is equipped with the law enforcing agencies including police which can check and contain the illegal mining but stopping the entire business is not the right way to tackle with the problem.
The Jammu Chamber also expressed resentment against the district administration for harassing the small traders by carrying out unnecessary encroachment drives without issuing any prior notices. He urged the district administration to desist from such activities which is not in favour of trading community.
The CCI President demanded either immediate roll back of the new policy or else the same be amended by the government to address the genuine concerns of the local wine traders whose families are dependent on this trade besides these traders providing employment to substantial number of people. The Chamber will try its best to save the interests of existing liquor vendors of the UT as they are forced to become scapegoats, he said and warned the government not to force the trading community to come on roads to get their demands fulfilled.

Jammu Chamber of Commerce & Industry urged the government to protect and safeguard the interests of the JKEL-2 license holders while implementing the Excise Policy 2021-22. These license should continue to be renewed on terms of the Jammu and Kashmir Liquor License and Sale Rules, 1984 governed by the J&K Excise Act SVT 1958.
The Chamber President Sh. Arun Gupta said that recent Draft Policy 2021-22 published has been framed totally in conflict with J&K Excise act SVAT-1958 as amended and finance department notification under SRO 679 dated 13-12-1984, as amended till date . It is settled position of law as a elaborated in related judgement of hon’ble High Court dated 28-12-2020, that no policy can supersede act and rules for regulations in any trade. Act and Rules are crystal clear and defining these JKEL-2 license holders as separate class are licensees on fixed fees i.e regular licensees.
Basic structure of grant and renewal of JKEL-2 license has been changed in new draft policy for JKEL-2 trade through e-auction mode. While hon’ble high court judgement dated 28-12-2020 clearly provided for framing of policy strictly in accordance with act and rules. The draft excise policy is not only in violation of Excise Act and rules but is also in total disregard to the judgement of Hon’ble High Court. The Hon’ble High Court Judgement in terms of para90(vii) clearly states that for the purpose of renewal of licenses for trade in liquor, if permissible in law, all conditions applicable for grant of new license shall also be applicable. This does not mean that renewal of earlier license is also to be done by way of auction. The licenses which have been granted by way of fixed fee per annum and is in operations for the last more than 5-6 decades is a class apart. In terms of rule 35 which clearly envisages a provision that government can grant a license in any other manner. This provision has to be read in reference to rule 4, as well as the other relevant rules with respect to grant of license by way of renewal. The grant of license is a well recognised conditions which is permissible under law and number of courts have upheld the policy decision of the government by way for which licensees already in existence on a fixed fee as a separate class apart.
It is not understood, why normative practise is not being adopted for trader involved in liquor who has served the department with his sweat and blood and is tested ground level worker of the department and has never defaulted on account of any type of dues and binding imposed by department prescribed in section 22 of the act. The renewal is very much permissible under law but shockingly the government has not dealt with said issues which is well established policy in different state.
We have strong reservation to the issues proposed in the draft policy. It has also been proposed that no obviate possibility of cartelization and monopolistic approach allotment is made to only one bidder. We may bring on record that most of regular licensee are having one license and are earning bread and butter for their families as only source of livelihood. All of them are working with such sincerity, accountability and honesty and serving as collection agent of the government.
E-auction individual will be granted license at only one location but the persons having muscle and money power will bid in name of all of their family members and also bid in name of proxies, who will be paid meagre amount for required purpose. Fact remains e-auction will bring big players and shall lead to cartelization and monopolistic approach.
Auction has been tested earlier in the year 2000 with the country liquor in erstwhile state of J&K and results are well known with the department. A related case and FIR, losses incurred on account of that amounting Rs. 100 crores are still pending adjudication. It is to bring on record that ever since accord of license, they have never defaulted on account of dues and persistently helping department in achieving its objectives besides helping to increase the revenue.
We request government that no systematic change be brought in grant of renewal of license of JKEL-2 Regular/Fixed Licensees which are a separate class, contrary to excise act and rules against the spirit of law. These may be allowed to run their licensed premises on fixed fees as per approved blue prints plans available with the department and same locations notified in draft policy in a normative manner as per spirit of hon’ble High Court order and settled position of law. JKEL-2 fixed licensee be renewed as per rules position and settled principle of law. The aforesaid draft excise policy to the extent of the JKEL-2 Regular / Fixed Licensee shall not be acted upon, as it is in disregard to the judgement of the hon’ble High Court.

The Jammu Chamber of Commerce and Industry today strongly flayed the Government decision to impose Property tax in the UT of Jammu and Kashmir and demanded for reconsideration of the decision.
Addressing the Media Personnel , Chamber of Commerce and Industry President Arun Gupta said, the employment and business of People of this erstwhile State is badly affected by post August 05, 2019 events especially due to prolonged shut downs and restrictions imposed by the Government. No major economic activity has taken place after the abrogation of Article 370 and 35 A. The State which is flooded with the unemployed youths and have limited resources and opportunities for economic activities has been burdened with one more tax to plunge into the deep economic crisis.
He said, After the spread of Pandemic Covid-19, the businesses are shut and people are left jobless, many states are considering to come to the rescue of people by exempting and reducing the existing taxes already in force. But on contrary the Government of J&K is imposing tax after tax to further weaken the people economically. The time when people are struggling to meet both ends needs, imposition of property tax is grave injustice and illogical.
The Chamber President reiterated that the time is not opportune to impose such taxes in a State which is economically, geographically and politically sensitive. The people are looking forward for a relief and tax holiday for business and trade at this time of distress but initiation of such decisions will further aggravate the already worsen economy of J&K.
Arun Gupta Added that the continuance of barrier at Lakhanpur Gateway has added to the vows of General public and passengers coming from the different places of India. People and Vehicles are made to stand in long queues for hours to get the clearance. Such practice should be immediately stopped to allow free passage to passengers and vehicles to and fro the UT.
The other Office bearers present in the Press Conference include Sh. Anil Gupta, Sr. Vice President, Sh. Gaurav Gupta, Secretary General, Sh. Rajesh Gupta, Secretary and Sh. Rajesh Gupta, Treasurer.
